This document constitutes the "Privacy Notice" of Grupo PM, S.A. de C.V. (hereinafter the "Company"), established to hear and receive notifications on Av. Coronel Ahumada No. 204, Col. Lomas del Mirador, Cuernavaca, Morelos, Mexico, C.P. 62350, which is made available to you (the "Holder") prior to the collection and processing of your personal data.
I. Object. This “Privacy Notice” governs the form, terms and conditions under which the Company, including its subsidiaries and related companies, are empowered and authorized by the Holder to access, process and transfer personal data (hereinafter "Data") of the “Holder.”
II. Excluded Data. The Website of the “Company” may include links to third party Websites. If you access those links, you will be leaving the Website of the “Company”, whereby the “Company” assumes no liability in connection with such third party Web sites.
If you publish, comment or share personal information, including photographs, in any public forum, social network, blog or other kind of forum, you should be aware that any personal data will be accessible to be published, viewed, obtained or used by other members of these forums, and could be used to contact you, send you unsolicited messages or for purposes that neither you, nor the “Company” can control. The “Company” is not responsible for the personal information you choose to submit in these forums or social networks.
III. Consent. The “Holder” hereby states under oath that:
If this "Privacy Notice" is available through a Website (Website, Internet Webpage or similar) or any other electronic device, the "click" to "accept" or otherwise continue browsing through the site, or the provision of “Data,” is a manifestation of consent to the processing of your “Data” by the “Company,” in accordance with this "Privacy Notice."
If this "Privacy Notice" is available through means such as audio, visual or any other technology, providing your “Data” is a manifestation of consent to the processing of your “Data” by the “Company,” in accordance with this "Privacy Notice."
If this "Privacy Notice" is available in writing, your signature, rubric, name or fingerprint, or providing your “Data” anywhere in the site is a manifestation of consent to the processing of your “Data” by the “Company”, in accordance with this "Privacy Notice."
All the information you provide is accurate and complete. The “Holder” shall be responsible at all times of the provided “Data.”
The “Holder” has the right to access, rectify, and cancel his “Data,” as well as to oppose to its processing, or to revoke the consent for that purpose, through the procedures set forth in this “Privacy Notice.”
IV. Sensitive Data. The “Holder” declares under penalty of perjury, that he has not provided and in no case will provide “sensitive personal data” to the “Company,” i.e. intimate personal information that, with due or undue use, may give rise to discrimination, or involves a serious risk of it.
In particular, the “Holder” agrees not to provide the “Company” with any information concerning racial or ethnic origin, present and future health condition, genetic information, religious, philosophical, and moral beliefs, union membership, political views, or sexual preference.
V. Data Collection. The “Holder” shall voluntarily provide “Data” to the “Company,” either in writing, orally, electronically, through surveys, direct access to the Website of the “Company, or by sending files electronically or otherwise, including but without limitation, direct delivery of information, access to the Website of the “Company,” customers or affiliates (where this “Privacy Notice” is mentioned), phone calls or telemarketing, e-mail solicitations, seminars, conferences or events, etc.
If you use or access our Internet sites or other electronic means, please note that our systems may collect the Data of the “Holder,” such as browser type, operating system, Web pages visited, IP address, etc. through "cookies" or "Web beacons" among others. Cookies are text files that are automatically downloaded and stored in the hard disk of the computer of the user to navigate a specific Website, which allows the Web server to recall some facts about the user, including preferences for the display of pages on that server, username, and password. Web beacons are images embedded in a Web page or email, which can be used to monitor the behavior of a visitor, such as storing information about the user's IP address, duration of interaction on that page and the type of browser used, among others.
You agree that the “Company” may also obtain the “Data” of the “Holder” by other means, such as information from other commercially available sources, as telephone directories, employment directories, business cards, public databases, etc.
All information and “Data” we collect on the “Holder” may be combined for the purposes permitted under this “Privacy Notice.”
VI. Use of the Data. The “Company” may use the “Data” for any of the following purposes:
Improvement of business processes. In the case of statistical data, internal processing, sales promotions, marketing research, sales offers, surveys, advertising or similar issues, we may require general information such as name, address (home and office), phone and fax numbers, and email address, information about commercial or consumer preferences, income ranges, studies, age ranges and /or socioeconomic level.
These “Data” can be used in ways stated but not limited to (i) Provide the goods and/or services you have requested or in which you have expressed interest; (ii) To ensure an efficient service, provide better customer service and enhance their experience in the use of certain products and / or services; (iii) Send and introduce goods and / or services that may be relevant or attractive, including participation in promotions, offers and advertising campaigns; (iv) Report changes or new products or services that are related to the contract or purchased by the customer; (v) To comply with our obligations to our customers; (vi) Evaluate the quality of service, or perform internal research on consumer habits.
Contact information or employment status. In the case of job listings or requests, the submission of resumes or CVs, job records or similar, we may require you to provide “Data” such as name, address, phone, mobile phone, fax, email, photos, information about academic degrees, academic and work history (previous employers) and information on interest in jobs, including skills and capabilities, contact information, socioeconomic status and preferences (including salary).
These “Data” can be used in ways stated but not limited to (i) The internal purposes of the “Company”, including keeping them as records in the area of Human Resources of the “Company”; (ii) Hiring or contracting independent services processes; (iii) Providing references if any other person or company requested reports on potential job or commission applicants; (iv) For internal legal obligations, including compliance with Social Security or similar; (v) For publication purposes if required as part of a human-resource strategy.
Information for business operations. If the “Data” is requested for a commercial operation, the “Company” may request information such as financial information, including credit card number, and other unique information such as user identification and passwords, billing and transaction information, banking details, etc.
The financial information specified above, including that relating to a credit card number is only used to process credit applications, payments, and fraud prevention.
This can be achieved by the treatment and use of “Data” directly through the “Company” or third parties to whom the data are transferred, as provided in the following section.
VII. Storage, dissemination and transfer of Data. “Data” can be transferred, stored, and processed in a country other than where it was provided, in which case, we transfer the information in accordance with the regulations on data protection.
The “Holder” understands and agrees that the “Company” is authorized to use, store, disclose, transfer, and to sell, assign, lease or otherwise sell or transfer the “Data.” In this case, the “Company” will celebrate contracts with third parties that provide the “Data,” which will incorporate the restrictions and other terms and conditions of this “Privacy Notice.”
If the “Holder” does not express objections to the transference of the “Data,” it will be considered as his consent.
Notwithstanding, the “Company” may also provide some of the “Data” to suppliers of goods or services that require this information. These suppliers include, but are not limited, to credit card processors, providers of customer support service and real time support, marketing, service providers, e-mail, automated data processors and carriers. These service providers are required by contract to maintain the confidentiality of the “Data” under this “Privacy Notice.”
VIII. Storage of Data. After receiving the “Data,” it will be processed and stored in a database that can be administered by the “Company” or a third party (inside or outside the country where the “Data” was provided) with which the “Company” has a contract to that effect.
The “Company” will incorporate protection mechanisms to avoid as far as possible deviations, tampering, loss, unauthorized consultation, or treatment of “Data.”
IX. Confidentiality. The “Company” will not disclose “Data” to unauthorized third parties, unless such disclosure is required by law or command of authority.
X. Access, rectification. The “Holder” shall be entitled to access personal information stored in the database of the “Company” and rectify, limit or update it when required, for which he must submit an application by mail or electronically to the manager:

The request for access, rectification, cancellation, or opposition must contain and attach the following:
The name and address of the “Holder” or other means to communicate the answer to the request;
Documents proving the identity or where appropriate, the legal representative of the “Holder”;
The clear and precise description of the personal “Data” on which any of the aforementioned rights is to be exercised, and;
Any other item or document that facilitates the location of the personal data of the “Holder.”
XI. Cancellation or Revocation. Applications for total cancellation of “Data” or consent revocation shall be made in accordance with the provisions on the previous section.
The cancellation of “Data” will result in a lockout period after which we will proceed to the suppression of “Data.” The “Company” may retain the “Data” only for liability purposes arising from its processing.
When the “Data” had been transferred prior to the date of modification or cancellation, and continue to be processed by third parties, the “Company” will bring this request to their attention for amendment or cancellation, without any further obligation on its behalf.
The “Company” is not obliged to cancel the “Data” when:
It should be provided by law;
It obstructs judicial or administrative proceedings related to tax obligations, investigation and prosecution of crimes or updating of administrative penalties;
They are necessary to maintain legally protected interests of the “Holder”;
They are necessary to perform an action in the public interest;
They are necessary to fulfill a legally acquired obligation.
XII. Amendments. The “Company” reserves the right to change this “Privacy Notice” at any time, and adjust it to new legislation, laws, or market practices.
The “Holder” agrees that any change to this "Privacy Notice" or privacy policy is notified by posting a notice on the www.grupopm.com Website. It is obligation of the “Holder” to visit the site frequently to verify the most current version of this “Privacy Notice.”
